All products sold by The Pep Club are intended strictly for laboratory research purposes only. We supply materials designated Research Use Only (RUO) that are not approved for human or animal consumption, medical use, diagnostic use, or therapeutic use. By purchasing from or using this site, you acknowledge and agree that all products are used solely for legitimate scientific research by qualified individuals or institutions in appropriate laboratory settings.

No Human or Animal Use

Products sold by The Pep Club are:

• Not intended for human consumption
• Not intended for veterinary use
• Not intended for injection, ingestion, inhalation, or topical use in humans or animals
• Not drugs, dietary supplements, cosmetics, or medical products

None of our products have been evaluated or approved by the FDA or any regulatory authority for medical or therapeutic use. The Pep Club does not provide dosing information, protocols, or usage guidance for human or animal use.

By purchasing from The Pep Club, you represent and warrant that:

• You are purchasing for legitimate laboratory research purposes
• You have the knowledge and training necessary to safely handle research materials
• You will use products only in controlled laboratory environments

No Medical Claims

Information on this site and in our materials is for informational and research context only and is not medical advice, treatment recommendations, health guidance, diagnostic information, or clinical instructions. The Pep Club does not claim that any product can diagnose, treat, cure, or prevent any disease or condition.

Laboratory Handling Responsibility

Research materials may present risks if improperly handled. Purchasers assume full responsibility for proper storage and handling, laboratory safety procedures, proper disposal, and compliance with applicable chemical safety regulations. The Pep Club is not responsible for misuse, improper handling, or unauthorized application of its products.

Prohibited Uses

Products may not be used for human consumption, veterinary or animal administration, compounding for human use, food/supplement/cosmetic manufacturing, or any application prohibited by law. Any attempt to purchase for prohibited purposes may result in immediate cancellation, account termination, and reporting to authorities where required by law.

Right to Refuse Service

The Pep Club reserves the right, at its sole discretion, to refuse any order, cancel transactions, limit quantities, or restrict accounts where we suspect products are being purchased for non-research purposes or misuse.

Welcome to The Pep Club. Please read these Terms carefully, they govern your use of thepepclub.us (the "Site") and any purchase of our products. "The Pep Club," "we," "our," and "us" refer to The Research Club LLC, doing business as "The Pep Club."

Agreement to Terms

By accessing the Site or purchasing any product, you affirm you are at least 21 years of age, are a qualified researcher, and agree to be bound by these Terms in their entirety, along with our Research Use Only Policy, Privacy Policy, and Material Transfer Agreement (each incorporated by reference). If you do not agree, please exit the Site.

Research Use & Compliance Disclaimer

Before purchasing, you acknowledge and agree that our products are for laboratory research purposes only and not for human or animal consumption; are not intended to diagnose, treat, cure, or prevent any disease; and should not be used as a food, drug, cosmetic, or for household use. It is your sole responsibility to ensure compliance with all laws in your jurisdiction.

Customer Representations & Warranties

By purchasing, you represent and warrant that:

• You are at least 21 years of age
• You are a qualified researcher or operate within a controlled laboratory environment
• You understand the health and safety hazards of handling laboratory compounds
• You have the knowledge, training, equipment, and facilities to safely handle these materials
• You will comply with all applicable local, state, federal, and international laws
• You maintain appropriate liability insurance for your research activities
• You accept that certain compounds may not be listed on the TSCA inventory, taking full responsibility for verifying compliance for your intended use

FDA & Legal Disclaimer

The statements and products on the Site have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. The Pep Club is a research-use-only (RUO) chemical supplier and is not a compounding pharmacy, medical provider, or outsourcing facility under Sections 503A or 503B of the Federal Food, Drug, and Cosmetic Act.

Account Eligibility & Refusal of Service

The club is for qualified researchers. If we believe a customer intends to use our products for anything other than legitimate research, we may decline or cancel the order, restrict or close the account, and add the customer's information to our internal do-not-sell records. Prohibited uses include human or animal consumption; diagnostic, therapeutic, or clinical applications; and compounding.

Orders, Pricing & Payment

Prices are invitations to do business, not binding offers; your order is an offer, and a contract forms only upon our confirmation. All customers must be 21 to order. Prices are in USD, exclude taxes, duties, and shipping, and may change without notice. We accept major credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay, ACH / bank transfer, and cryptocurrency through compliant providers.

ALL SALES ARE FINAL. Orders are non-cancellable once payment is processed. No refunds are issued except for products with verified manufacturing defects.

Chargebacks

Chargebacks submitted for delivered, refused, or stolen packages will be disputed using carrier confirmation, delivery records, and your agreement to these Terms.

Returns & Refunds

All sales are final due to safety and contamination risks: no returns, no refunds (except verified manufacturing defects), no cancellations after payment, and no exchanges. Inspect shipments immediately; report issues in writing to info@thepepclub.us within seven (7) calendar days of delivery, with photographic evidence.

Limitation of Liability

To the fullest extent permitted by law, The Pep Club's total liability shall not exceed the purchase price of the specific product, and we are not liable for indirect, special, incidental, consequential, or punitive damages, lost profits, business interruption, or personal injury after title transfer.

Waiver of Liability & Indemnification

In direct consideration of the sale, you agree to indemnify, defend, and hold harmless The Pep Club and its owners, members, managers, officers, employees, affiliates, agents, and suppliers from any claims, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: your use, handling, storage, transfer, or disposal of any product; any breach of these Terms; any violation of applicable law; or any injury to persons or damage to property from your activities.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute through good-faith informal negotiation for thirty (30) days. Unresolved disputes shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Texas.

The Pep Club does not share, sell, or rent your mobile phone number, SMS opt-in, or messaging consent information with any third parties or affiliates for their marketing or promotional purposes. Mobile information collected through our SMS program is used solely to operate that program.

This Agreement governs the purchase, transfer, and use of all research materials, peptides, research chemicals, solvents, and laboratory supplies ("Materials"), from The Pep Club. By purchasing, you agree to be bound by all terms here. All Materials are strictly for in vitro research purposes only, for use by qualified professionals in controlled laboratory settings.

Purchaser Qualifications

You certify and warrant that you:

• Are a trained professional in a relevant scientific field
• Are affiliated with a legitimate research institution, university, or qualified laboratory
• Are at least 21 years of age and legally authorized to purchase research materials
• Possess the expertise to safely handle, store, and use research chemicals
• Have appropriate facilities, safety equipment, and waste disposal
• Will restrict Material access to authorized, trained personnel only

Permitted Uses

• In vitro research and experimentation in controlled labs
• Non-diagnostic laboratory analysis
• Educational purposes within accredited institutions
• Development of research protocols
• Basic research and R&D in compliance with TSCA (15 U.S.C. §2601 et seq.)

Strictly Prohibited Uses

• Human consumption or administration. Materials must never be consumed, injected, inhaled, or administered to humans
• Veterinary or animal treatment
• Clinical applications, including clinical trials, patient treatment, or medical diagnosis
• Diagnostic purposes (Materials are not validated per 21 CFR 809.10(c)(2)(i))
• Manufacturing or commercial production without proper licensing
• Resale or redistribution to third parties
• Any illegal activity under local, state, federal, or international law

Regulatory Compliance

You agree to comply with applicable federal regulations, including TSCA; FDA "Research Use Only" labeling under 21 CFR 809.10(c)(2)(i); DEA regulations where applicable; OSHA Hazard Communication (29 CFR 1910.1200); EPA waste rules; and DOT transport rules, and all state and local licensing, storage, waste, safety, and fire-code requirements.

Storage & Handling

Store Materials exactly as labeled; keep them in secure, access-controlled storage; allow only trained personnel to handle them; require PPE; maintain receipt, use, and disposal records; consult the SDS before handling; and dispose of all Materials as hazardous waste in compliance with applicable regulations.

Indemnification

You agree to indemnify, defend, and hold harmless The Pep Club, its officers, employees, agents, and suppliers from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use, handling, storage, or disposal of Materials; any breach of this Agreement; any violation of law; any injury to persons or damage to property from your activities; or any unauthorized use or distribution of Materials.

Governing Law

This Agreement is governed by applicable federal law (including TSCA and FDA regulations) and the laws of the State of Texas.

Acknowledgment & Acceptance

By placing an order, you acknowledge you have read and understood this MTA, meet all qualifications, will use Materials only for permitted research, will not administer Materials to humans or animals, will comply with all laws, and accept our Shipping, Refunds, and Returns policies.

The Pep Club respects your privacy. This policy explains how we collect, use, and protect information when you use our services.

Collection of Information

We may collect: name, shipping and billing address, email, phone, and payment details when you create an account, place an order, or contact us; your date of birth for age verification (to confirm you are 21+); and technical data such as IP address, browser type, and browsing activity.

Use of Information

We use information to process and fulfill orders; verify your age and eligibility; provide support; improve functionality and security; comply with regulatory and legal obligations; prevent fraud; and send communications you have opted into.

Sharing of Information

We do not sell or rent your personal information. We share limited information only as needed with payment processors and shipping carriers, and with legal or regulatory authorities if required by law or to enforce our Terms.

Data Security & Retention

We use commercially reasonable safeguards, including 256-bit SSL encryption. No method of transmission or storage is completely secure. We retain personal information only as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, and resolve disputes, after which we securely delete or anonymize it.

Your Rights & Choices

Depending on your location and applicable law, you may have the right to access, delete, correct, or receive a portable copy of your personal information. To exercise any right, contact info@thepepclub.us.

SMS / Mobile Messaging

If you opt in to receive text messages from The Pep Club, we collect your mobile phone number and a record of your consent (including timestamp and IP address). We use this information solely to send the messages you have opted into and to provide customer support.

The Pep Club does not share, sell, or rent your mobile phone number, SMS opt-in, or messaging consent information with any third parties or affiliates for their marketing or promotional purposes. Mobile information collected through our SMS program is used solely to operate that program.

Fulfillment Timeline

Orders placed before 1:00 PM CST typically ship the same business day, no later than the next business day. Orders placed after 1:00 PM CST, on weekends, or on holidays will ship the next business day.

Carriers & Coverage

We ship to all 50 U.S. states via UPS, FedEx, and USPS. We do not ship internationally.

Shipping Protection

All orders include Shipping Protection by default, applied automatically at checkout. It covers qualifying non-delivery, damage, or fulfillment issues subject to our Shipping Protection Terms.

Delivered Packages

The Pep Club is not responsible for packages marked "Delivered" by the carrier and subsequently lost or stolen, outside the coverage defined in our Shipping Protection Terms. Customers are responsible for ensuring a secure delivery location, monitoring tracking, and retrieving packages promptly.

Non-Delivery, Damage, or Fulfillment Errors

These must be reported within seven (7) calendar days of the carrier's delivery or attempted-delivery date. Required documentation: an unboxing video recorded from the moment the package is first opened; photos of the external packaging; photos of the contents; photos of the packing slip; the tracking number; and a brief written description. Incomplete claims will be denied. Verified Pep Club errors are reshipped at no additional cost; no cash refunds are issued.

All sales are final. Orders cannot be canceled or modified once placed. Due to the sensitive nature of research materials and applicable regulations:

• Returns are not accepted
• Refunds are not issued for change of mind, user error, or refused delivery
• Chargebacks for delivered or stolen packages will be disputed with supporting documentation
• Reshipments are considered only for verified fulfillment errors or shipping damage that meet our documentation requirements

Our Commitment

We are committed to accurate fulfillment and timely shipping on every order. To keep things fair and protect all parties, these policies are strictly enforced. By placing an order, you acknowledge and agree to these terms.

By including Shipping Protection at checkout, you agree to the following terms.

What's Covered

• Packages lost in transit prior to delivery
• Packages damaged during shipping
• Verified fulfillment errors

Coverage applies from the moment your order is shipped until delivery.

What's Not Covered

• Incorrect or incomplete addresses
• Delays due to customs, weather, carrier disruptions, or circumstances outside our control
• Unclaimed or refused packages
• Packages marked delivered
• Stolen packages
• Orders seized, delayed, or returned by customs or regulatory authorities
• Claims submitted outside the required reporting period

Claim Process

Claims must be submitted within seven (7) calendar days of the carrier's delivery, attempted-delivery, or scheduled-delivery date. For suspected lost packages, you must first notify The Pep Club and initiate any required carrier investigation, and allow a minimum recovery period of 24–48 hours before review.

Resolution

Approved claims may be reshipped or replaced at the sole discretion of The Pep Club. Cash refunds, store credits, and alternative compensation are not guaranteed. All coverage decisions, approvals, denials, and resolutions are made solely at The Pep Club's discretion and are final.

The Pep Club may modify or terminate its affiliate program or these terms at any time in its sole discretion, with or without notice.

Program Overview

• Customers receive 15% off their order when they enter an affiliate's code at checkout.
• Affiliates earn 15% store credit on qualifying net sales (post-discount product subtotal, excluding shipping and tax).
• Commission is earned only when the affiliate's code is entered at checkout on that specific order.
• Commission is not recurring. A customer's future orders earn commission only if the affiliate's code is entered again on those orders.

Compliance Requirements

Affiliates may only use approved Pep Club copy and creative. Affiliates may not:

• Make any medical, therapeutic, weight-loss, efficacy, or dosing claims
• Reference FDA-approved drugs by name
• Describe products as fit for human or animal use
• Publish peptide-naming content without pre-approval
• List on any marketplace (eBay, Amazon, TikTok Shop, Etsy)
• Promote on third-party discount or coupon websites
• Make self-purchases to earn commission

Violations & Termination

Violations result in immediate termination of the affiliate account and forfeiture of any unpaid commissions, without refund or compensation. Terminated affiliates are permanently barred from re-enrolling. The Pep Club's determination of a violation is final and binding.

Affiliates are independent contractors, not employees or agents, and agree to indemnify The Pep Club for claims arising from their own content or conduct.
